General terms and conditions of sale
1. Purpose
These general terms and conditions of sale (hereinafter "GTC") define the rights and obligations of the parties in the context of the online sale of products offered by ALEMINET SERVICES SL , trading as "Kings Canapé" (hereinafter "the Seller"), to any individual consumer (hereinafter "the Customer") via the website [ www.kingscanape.com ] ] (hereinafter "the Site"), as well as in the context of orders placed remotely (telephone, email, messaging, WhatsApp, social networks, etc.).
Any order placed with the Seller implies full and complete acceptance of these Terms and Conditions, which prevail over any other document.

3. Products offered
The Seller primarily offers:
-
sofas made to order, customizable (upholstery, material, color, configuration, according to the collections, color of the legs: black, chrome, gold);
-
display models , sold as is;
-
armchairs ;
-
specific mattresses for sofas ;
-
side tables for sofas ;
-
fabric samples , free of charge up to a limit of 8 samples per customer .
The essential characteristics of the products (dimensions, possible configurations, options, materials, etc.) are indicated on the product sheets or communicated to the Customer (quotes, purchase orders, written exchanges).
The products are delivered in modular form, in several packages, to facilitate transport and delivery.
Photographs and visuals are for illustrative purposes only: color variations may occur depending on screen settings and dye lots. For technical reasons, slight color variations are acceptable and do not constitute grounds for a complaint.
A dimensional tolerance of ± 5 cm is allowed on the dimensions of the furniture, related to the materials used (foams, fabrics, structure).
4. Customized products & display models
4.1. Customized Products
The majority of sofas and some products are made specifically to the Client's request , with customization of the upholstery, color, configuration and, depending on the collections, the color of the legs.
These products are clearly personalized goods within the meaning of Article L221-28 of the Consumer Code.
4.2. Display Models
Display models may be offered for sale, usually at a preferential price. They are sold as is , with any minor marks related to their use in the showroom.
Given their particular nature:
-
Display models cannot be returned ;
-
No right of withdrawal applies to these models, except in the case of a major defect or proven non-conformity at the time of delivery.
However, the consumer's mandatory rights regarding legal guarantees remain applicable.
5. Price
Prices are shown in euros, inclusive of all taxes (TTC) , excluding delivery charges.
For mainland France (excluding Corsica) , delivery costs are calculated automatically at checkout based on the address and the basket.
For other destinations (Belgium, Luxembourg, Switzerland, Germany, Netherlands, Corsica or other countries), the Customer must contact the Seller by email to obtain a delivery quote.
The Seller may change its prices at any time, but applies the rate in effect at the time of the order.
Promotional codes/one-off discounts may be offered, subject to specific conditions (duration, minimum purchase, products concerned, etc.).
6. Customer order and responsibility in choosing options
6.1. Ordering via the Website
The customer selects the products and their customization options (upholstery, color, configuration, legs, etc.) and adds them to the cart. A summary allows them to check the items before confirming.
The order is final after:
-
verification and confirmation of information;
-
acceptance of the terms and conditions;
-
payment according to article 7.
6.2. Remote control (telephone, WhatsApp, email, social networks…)
The customer can order via phone, WhatsApp, email, or messages. In this case:
-
The Seller sends a purchase order / a summary invoice .
-
The Client confirms in writing (email, message).
-
The order is launched after receipt of a 50% deposit by bank transfer .
These terms and conditions apply to all orders.
6.3. Customer Order Verification
Before validation, the Customer must absolutely check the following elements, particularly for corner sofas and personalized products:
-
the side of the corner sofa (left/right), according to the diagrams/indications of the product sheets;
-
the color of the main coating ;
-
the color of the decorative cushions (by default, the same as the sofa unless otherwise specified);
-
In the case of two-tone : the precise distribution of colors (seat, backrest, structure, armrests, etc.) according to what is agreed with the Seller.
Kings Canapé is not responsible for order errors resulting from incorrect selection or misinterpretation of these elements by the Customer. Any late correction may incur additional charges (see article 8).
6.4. Access and delivery feasibility
As the products are delivered in modules, some of which can weigh up to 70–100 kg , the Customer must check:
-
the width of the stairs, doors, corridors ,
-
the presence or absence of an elevator ,
-
any access restrictions .
A list of package dimensions and weights is available on the product pages or upon request. The Seller cannot be held responsible for delivery failures due to narrow or unsuitable access.
7. Payment terms
7.1. Accepted payment methods
-
Credit card : for orders placed on the Site, full payment is due at the time of order ;
-
Bank transfer :
-
for 50% deposits on remote orders,
-
for payments in 2 installments (deposit + balance),
-
for payment of the balance upon delivery when stipulated.

7.2. Payment in 2 installments by bank transfer
Upon request:
-
50% deposit upon order to start production;
-
The remaining 50% will be paid by bank transfer upon delivery .
The Seller may refuse to deliver until the balance is paid in full.
7.3. Default of payment
In the event of refusal of payment, non-payment or delay, the Seller may suspend or cancel the order and/or delivery.
8. Manufacturing, customization & modifications
Custom sofas and products are made to order , according to the customer's specifications.
The Customer has 24 to 48 hours after validation of their order to request a modification (fabric, color, configuration, etc.).
After this period:
-
production and purchasing of materials may be undertaken;
-
Any modification may be:
-
refused, or
-
accepted with additional costs charged (raw materials, labor, production reorganization, etc.).

9. Delivery
9.1. Delivery Zones
The Seller primarily delivers:
-
Metropolitan France (excluding Corsica) ;
-
Belgium, Luxembourg, Switzerland, Germany, Netherlands , delivery quote available upon request.
For other countries, a specific quote is provided upon request.
9.2. Delivery Organization
The manufacturer or carrier contacts the Customer by phone or email to inform them of the date and approximate delivery window .
Deliveries generally take place from Monday to Saturday , during time slots ranging from 6am to 11pm , depending on the delivery routes.
The exact delivery date is set by the Seller or its carrier.
9.3. Types of service
-
By default : delivery to the foot of the building or in front of the house.
-
Option “help to the living room” :
-
the driver is alone ;
-
He can help the customer assemble the sofa in the desired room.
-
This assistance must be requested at the time of ordering .
-
It gives rise to an additional charge generally between €30 and €50, which is communicated to the Client.
-
The driver is not required to install the furniture (complete assembly, final placement, removal of packaging), unless a specific service has been agreed upon.
Final assembly is only offered in the Alsace region , according to conditions and prices communicated to the Client.
9.4. Indicative delivery times
-
Custom sofas and products: on average 6 to 8 weeks from the order and/or receipt of the deposit;
-
Fabric samples: 2 to 5 working days .
These delivery times are indicative. The Seller will inform the Customer in the event of a foreseeable delay.
9.5. Customer Absence & Second Visit
The Customer is informed of the date and delivery window.
If the carrier arrives at the agreed address and:
-
The customer is absent, or
-
Access is impossible due to incomplete or incorrect information.
A second delivery attempt can be arranged. The corresponding costs will be borne by the Customer , except in the case of an error by the Seller/carrier.
10. Product receipt & transport-related claims
10.1. Verification in the presence of the driver
In the event of delivery, the manufacturer/seller requires the customer to:
-
carefully inspects the packages in the presence of the driver ;
-
In case of visible damage (impact, torn cardboard, crushing marks, etc.):
-
take photographs of the packages and/or damaged items;
-
have a damage report drawn up or mention specific reservations on the delivery note.
-
This procedure is essential for the Seller to be able to exercise recourse against the carrier and effectively process the transport-related claim.
10.2. Delivery times & packaging
In the event of damage being observed:
-
The Customer must inform the Seller immediately or at the latest within 24 hours of delivery, by email with supporting photos;
-
In case of damage discovered after unpacking, it is imperative to keep the original packaging , which may be required to process the claim.
Without a report or photos, it may be difficult, or even impossible, to determine whether the damage occurred during transport or after delivery, which may compromise coverage under transport damage.
These requirements do not, however, deprive the Client of his legal rights (guarantee of conformity, hidden defects).
10.3. Possible solutions
In the event of a damaged or non-conforming product (model, color or configuration different from the order), the Seller will offer several solutions:
-
repair ;
-
partial or total replacement ;
-
trade discount .
The chosen solution will be determined in consultation with the Client, in compliance with legal regulations.
11. Right of withdrawal
11.1. Customized Products
Custom sofas and products are clearly personalized goods .
In accordance with Article L221-28 of the Consumer Code, no 14-day right of withdrawal applies .
No return can be required for a simple change of mind, taste or a mistake in dimensions on the part of the Customer.
11.2. Display Models
Display models are sold as is and cannot be returned .
They are not subject to the right of withdrawal, except in the case of a major defect or proven non-conformity, subject to the consumer's legal rights.
11.3. Other non-personalized products
For non-personalised products (certain accessories, etc.), the Customer has a right of withdrawal of 14 days from receipt.
In this case :
-
The Customer notifies the Seller of their decision within 14 days;
-
He returns the product at his own expense , in good condition, clean, unused, to the following address:

The Seller will refund the price of the product after receipt and verification.
12. Legal guarantees & terms of use
12.1. Legal Guarantees
The products benefit from:
-
of the legal guarantee of conformity (2 years);
-
of the guarantee against hidden defects .
These guarantees apply in the event of a defect rendering the goods unfit for use or not conforming to the agreed characteristics.
12.2. Installation
The furniture is delivered in modules equipped with pre-installed hooks for easy assembly:
The assembly consists of fitting the elements together using these hooks, without any special tools.
The Seller and the manufacturer decline all responsibility for any damages resulting from:
-
from an incorrect assembly ;
-
of use not in accordance with the intended purpose of the furniture.
12.3. Terms of Use & Exclusions
To preserve the lifespan of the furniture, the Customer must follow these instructions:
-
avoid prolonged exposure to sunlight , which can cause discoloration of fabrics and wooden elements;
-
do not place furniture near heat sources (radiator, fireplace, etc.);
-
be careful with heavily dyed textiles (denim, etc.) which can transfer onto the coating;
-
Some fabrics (plaids, blankets) may leave lint or pill the coating, which is not covered by the warranty.
In the case of leather, imitation leather or delicate upholstery:
-
avoid all contact with sweat, grease, solvents, alcohol, chemicals ;
-
use only suitable cleaning products.
Regarding HR-35 foam:
-
It offers a firm, elastic and high-density seat;
-
With time and intensive use, a gradual loss of density (up to ~40%) is normal ;
-
the seat becomes more flexible: this is a natural phenomenon and not a defect.
Usage recommendations:
-
use the sofa evenly (avoid always sitting in the same place) to limit deformations;
-
avoid sitting on the joints between seats, which can weaken the structure;
-
Maximum recommended load: 90–100 kg per seat ;
-
To maintain a beautiful appearance, knead and shape the cushions regularly.
Corner sofas are only suitable for occasional use as sleeping accommodations :
Their surface is firmer than a bedroom bed, which is not a defect.
Other features:
-
Additional seams may appear on the seats depending on the width of the fabrics; this is part of the normal production process;
-
For models with high legs , a dull noise at the level of the casters or guides when sitting down is normal and does not affect use;
-
armrests are not intended to be used as seating: cracks/breaks at this level are not covered.
Packaging :
-
It is advisable not to keep the furniture in its packaging for more than 5 days after delivery;
-
Beyond that, fabric deformations or color variations may occur, which are not covered by the warranty.
12.4. Maintenance & Cleaning
For stains:
-
gently dab the stained area, then clean a wider area to avoid rings;
-
Avoid soaking the seat deeply: excess liquid can deform the foam and damage the fabric.
12.5. Relax function
On models equipped with a relaxation function (retractable footrest):
-
This element is intended solely for supporting the legs in a relaxed position ;
-
It is not intended for:
-
sit,
-
stand on it or climb on it,
-
jumping or putting all your body weight on it.
-
Improper use may damage the structure, actuators or mechanism, and is not covered by the warranty.
The manufacturer and the seller decline all responsibility in the event of a dispute related to failure to comply with the instructions for use.
13. Responsibility
The Seller cannot be held responsible for:
-
the consequences of an incorrectly filled-out order (choice of angle, color, dimensions, address, etc.);
-
from use not in accordance with the instructions;
-
of an impossibility of delivery due to insufficient access or the absence of the Customer;
-
of facts relating to a third party or a case of force majeure .
The Seller's liability is in any event limited to the amount of the order concerned, unless otherwise required by mandatory legal provisions.
14. Personal data
Personal data is processed in accordance with the GDPR and the Kings Canapé privacy policy, available on the Site.
The Customer has the right to access, rectify, object to, erase, and transfer their data, which they can exercise by contacting: contact@kingscanape.com .
15. Intellectual Property
All content on the Site (texts, photos, visuals, logos, videos, product sheets, 3D models, etc.) is protected by intellectual property rights.
Any unauthorized reproduction or use is prohibited.
16. Mediation & Applicable Law
In the event of a dispute, the Customer should first contact Kings Canapé customer service to seek an amicable solution.
In the absence of an amicable resolution, the consumer Client may resort to a consumer mediator (whose contact details will be provided upon appointment) and/or bring the matter before the competent courts.
These Terms and Conditions are governed by French law , without prejudice to any mandatory provisions that may be more protective of the consumer in their country of residence.
17. Amendment to the General Terms and Conditions of Sale
The Seller may modify these Terms and Conditions at any time.
The applicable terms and conditions are those in effect on the date of the order, as accepted by the Customer.
